			<content:encoded><![CDATA[<p>It is important to understand the process of buying a bank owned property.<a href="http://searchonprescott.com/files/2011/02/DSC01076.jpg"><img class="alignnone size-thumbnail wp-image-5107" title="DSC01076" src="http://searchonprescott.com/files/2011/02/DSC01076-150x150.jpg" alt="" width="150" height="150" /></a></p>
<p>The purchase of a bank-owned home is unlike purchasing a home from a typical homeowner.  Here is why: Once a property has been foreclosed or returned to the bank it becomes an REO (Real Estate Owned) asset of the bank. Those assets are assigned to an Asset Manager who is probably located in another state and has likely never seen the property. They have hundreds of these asset REOs to liquidate for the bank. They have no emotional tie to the property. It is now just inventory to them.</p>
<p>The bank first contacts a local agent who values the property via a Broker Price Opinion. It is assigned a value and the asset then awaits disposal.</p>
<p>Once the Asset Manager is ready to dispose of the property, he contacts another agent  working in the area. Sometimes that agent is the only one in the state representing the bank who doesn’t even necessarily understand the local market. They are simply given the property to list for sale and generally have many of these bank-owned properties they represent.</p>
<p>The Asset Manager does not work within the customary and usual ways of traditional sales in a given market. They operate under their own rules and use their own forms. You must agree to buy a home under those terms or your offer is rejected. Those forms and terms are designed by the bank’s lawyers to protect <em>only</em> the bank.</p>
<p>The Asset Manager will not provide any disclosures or insurance claims history. It is strictly up to the Buyer to find out whatever they can about the property during a short inspection period after an offer is accepted. The property has often not been well maintained before foreclosure and may even have been damaged by the prior owner. You buy “As Is”. You have the responsibility to discover what “As Is” is. Once you have investigated the condition of the property, you must sign off on the existing condition or reject it and cancel the purchase. This is where your earnest money becomes non-refunable in buying  foreclosures in Prescott Arizona uless your loan does not go through.</p>
<p>The bank’s forms or addendum may hold you to a penalty of up to $100 per day for every day you are late in closing the purchase for any reason including your lender not funding in time. If <em>they</em> are the responsible party for a late closing, they are not subject to any penalty. You are held to a timetable but the banks are not. Time means little to them. Remember this is a non-emotional liquidation of an asset.</p>
<p>The bank will answer your offer only through their listing agent when they get to it. They may wait for other offers to encourage multiple <em>higher</em> offers. And, they may take a lower offer for undisclosed reasons or reject all offers. They may have listed it for sale at a price they would not sell it for only to stimulate showing activity. The time of acceptance that you give them in your offer does not require them to answer in a timely manner. It is only there for <em>you</em> to have a way to end the negotiation on your end. It puts no demand or obligation on the Seller (bank) to answer your offer within that specific time limit.</p>
<p>Once an offer is accepted, it will be subject to the bank’s additional forms, terms, and addenda. Every bank has these prepared by their lawyers. They also select the title and escrow company. You either agree to their terms or they will not sell the property to you.</p>
<p>Your close of escrow and time of possession is not emotional to the bank’s Asset Manager. They don’t care if you have your belongings waiting in a truck to move into a home. They don’t care if <em>they</em> have one more document to sign before <em>you</em> can get your keys after recording of your closing documents. They do not work past 5 PM in whatever time zone they are in and are not located in the local bank branch. They are in an office somewhere else and may have dozens of files to close a particular day&#8211;perhaps as many as 500 files on their desk in various stages of liquidation. <em>You</em> are strictly a number buying their asset.</p>
<p>As long as you are willing to work under these conditions, you may find a great property at a discounted price. It may be worth the extra time, hassle, and discouragement that you are likely to encounter along the way.  Just be forewarned and then you won’t be surprised. <p>What are you earning on the money you have in the bank? Not much? Here is a solution: If you are selling property and will take your money and put it in the bank just change your strategy. Buyers are having a difficult time securing financing today. That is especially true of the self employed. As a seller you could offer terms to the buyer and be the bank for them.  You would earn a lot more than the 1/2% the bank is paying these days. And your investment is pretty secure. You have the property as collateral.</p>
<p>Buyers are willing to pay not to use traditional bank financing. The interest you will earn may be much more than market interest rates for mortgages. It is not unreasonable for a seller to ask for 2-4% over the current market rate.</p>
<p>Not only  will you earn more, but you will increase the chance of selling your property because you make the money available for the buyer.</p>
<p>This may also be a good investment even if you are not selling anything. You could be a private lender and earn high rates of return instead of leaving your cash in a bank.</p>
<p>Payments for these arrangements are made through  the account servicing department of a title company. They track the payments and provide statements. The buyer /borrower pays the fees.</p>
<p>In the event of a default, you get the property and keep all the payments that have been made along the way.</p>

			<content:encoded><![CDATA[<p>United Blood Services held the annual Silent Heroes appreciation evening at Mesa’s Commemorative Air Force Museum on Friday April 9th. There were over 200 donors attending the event. Silent Heroes includes all the platelet donors in Arizona.</p>
<p>Scott Light of channel 12 news was the Master of Ceremonies for the evening. He introduced Lee Doerr, Congressional Medal of Honor winner. 86 year old Lee was just awarded the medal for her service in WWII as a Women Airforce Services Pilot (WASP) pilot. Lee spoke of her experiences delivering and relocating over ten types of aircraft during the war. Most of the planes were experimental. Our highly polarized congress unanimously voted to award the medals to the WASPS who served their country. This compliments veteran status granted to them over 30 years ago.</p>
<p>Scott also introduced Katie Clarke, who when a 3 week newlywed was diagnosed with leukemia. She is now a cancer survivor alive today as a result of platelet donations for her cancer treatment. Awards were presented to those who donated from 12 to 24 times during the past year. Over 5 million units of blood or it’s components have been given since United Blood Services started in 1943 as one of just three blood banks in the United States to collect blood for the War. <a href="http://searchonprescott.com/files/2010/04/cann.jpg"><img class="alignright size-thumbnail wp-image-485" title="cann" src="http://searchonprescott.com/files/2010/04/cann-150x150.jpg" alt="" width="150" height="150" /></a></p>
<p>C’Ann Simpson and Jerry Germansen are regular platelet donors. They make the trip into Phoenix from Prescott, about an hour and a half, monthly. Jerry was awarded his first Gallon Pin in 2009 for a cumulative donation of over a gallon of the platelet component of blood. Platelets are collected through aphaeresis of the blood. Blood is extracted from the donor’s arm and sent through equipment that removes the platelets and return the remaining blood to the donor. The process takes about 3 hours using one arm all while resting in a chair watching a movie or reading. Both C’Ann and Jerry would love to see you <a href="http://searchonprescott.com/files/2010/04/Jer.jpg"><img class="alignright size-thumbnail wp-image-486" title="Jer" src="http://searchonprescott.com/files/2010/04/Jer-150x150.jpg" alt="" width="150" height="150" /></a>join them and become a donor. They say that you get much more out of the experience than you give. It is the one thing that most people can give freely. Part of the processing and testing is analysis of your cholesterol level and taking your blood pressure. Some day you may need life saving platelets.</p>
<p>I experienced the need in my family about 15 years ago. I know the value of this donation from that time in my life. It is one thing that money can’t replace. Thank God that there were donors taking the time to keep a supply available for my wife during cancer treatment.</p>

			<content:encoded><![CDATA[<p><strong>Shared Wells</strong></p>
<p>Shared wells are viewed positively by some and negatively by others. I hope to dispell some myths and tell it like it is. Water in central Arizona&#8217;s Prescott Quad-City area is a precious commodity. We live in an Active Management Area and under the law we cannot import or export our water. Shared wells have their place here.</p>
<p>Here are both sides of the story.</p>
<p>Negative Aspects:</p>
<ul>
<li>Requires a cooperative effort between neighbors to conserve water.</li>
<li>One party could be viewed as using a disproportionate share of the water.</li>
<li>There is less self freedom</li>
<li>Requires collecting of electric costs and periodic maintenance costs.

<p>Although a cooperative effort is required, conservation is good for the well and the community. Disproportionate use can be accounted for by metering usage and charging for the water as part of the maintenance fund for future repairs or upgrades. This may include drilling deeper in the event of a well going dry or a new well. Electric costs can be metered. A separate electric meter can be installed on the well and direct payments arranged with the utility company from the maintenance fund.</p>
<p>Positive Aspects:</p>
<ul>
<li>Reduced initial cost per household</li>
<li>Guaranteed water if an existing well is shared</li>
<li>Monthly budgeting toward maintenance</li>
<li>Shared costs of maintenance</li>
<li>Well monitored for operation by multiple parties</li>
</ul>
<p>Weather there is 1 straw in the ground or 5 straws in the ground, the same aquifer is being used for drawing all the water. There is not a lot of difference having more than one household on a well.</p>
<p>A good shared well agreement prepared with legal assistance should contain the following:</p>
<ul>
<li>The legal description of the well site and waterline easements.</li>
<li>How monthly costs and the maintenance reserve will be collected and any cap amount?</li>
<li>How the electric bill is paid?</li>
<li>Is the usage metered or is the usage electric split equally?</li>
<li>When does payment begin if one party is a vacant lot owner?</li>
<li>How are decision about maintenance and upgrades reached?</li>
<li>How is the agreement amended and by what percentage of the participants?</li>
<li>What happened if one party does not contribute?</li>
<li>What happens if one party vacates the well and drills his own?</li>
<li>What happens if municipal water becomes available?</li>
<li>Does the reserve stay with the property in the event of a sale?</li>
<li>Is there a hold harmless clause?</li>
</ul>
<p>Shared well agreements can be arranged for up to 13 properties. 14 or more shared well properties are legally considered a water company which requires monitoring for water quality standards and reporting.</p>
<p>All this may appear to be complicated. However, once an agreement is in place, the benefiting parties can save a lot of money and have a good water source. These agreements are particularly valuable in areas of spotty water when a good well is found.</p>
<p>I personally live on a 4 party shared well and enjoy the benefits.</p>
